Taking into account that some products are handcrafted, there may be slight differences between the image and the product itself, due to the raw materials themselves and the production process. However the images of the products available on the site are as reliable as possible.
In case the information presented does not correspond to the characteristics of the article, the Customer assists the right to terminate the purchase and sale agreement in accordance with applicable legal terms.
Despite our efforts, and to check prices whenever we proceed with the preparation of an order, it may happen that some products are priced incorrectly. If this happens, we will contact the customer by email, in order to inform you the value to be returned to you, in case the price of the product is lower than the price advertised in the online store or to communicate the situation, if the price is higher . In this case we will wait for the customer's decision to accept the correction or cancel the order within 14 days (from the date the incident was communicated to the customer).
4. PRIVACY AND DATA PROTECTION
MyCozyLand, as the controller, understands and recognizes the need and importance of protecting the privacy of its customers. For this reason and in compliance with the provisions of Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of their personal data and the free movement of such data (hereinafter the "RGPD" ), as well as the national legislation implementing the RGPD to MyCozyLand informs that personal data (name, surname, fiscal address and / or parcel delivery, postal code, city and country, VAT, telephone number and / or mobile phone and e-mail address) that the customer provides through the use of the online store or by registration in the same will be used for full compliance with the contract, namely for the processing and delivery of orders, for billing purposes and for the identification of the customer in the event of any complaints or requests for refund being submitted to MyCozyLand, based on the grounds of legitimacy of performance of the contract and the interest (in the case of complaints) provided for in Article 6 (1) (b) and (f) of the RGPD.

MyCozyLand warns that the provision of personal data in question is necessary for the contract to be fully complied with. In case the data indicated as obligatory are not provided, the delivery of the goods may be compromised. Further, the request for deletion of the data or opposition to the treatment, will not compromise the execution of the contract and the respective delivery of the property in progress.

Personal data of customers shall be kept for the period of time deemed necessary for each purpose, always following the principle of limitation of the conservation and minimization of data (Article 5º, nº 1 line c) and e) of the RGPD). Contact information strictly necessary for the marketing purpose will be kept for a period of one year after the last contact with the owner. The billing data strictly necessary to prove the contractual relationship will have to be kept for a period of 10 years, in accordance with article 123º/4 of the Tax Code on the Income of Collective Persons.

6. DUTIES OF USERS AND CLIENTS
The Client and the User undertake to respect and comply with these General Conditions of Contract and Use, namely:

7. CREATE CUSTOMER ACCOUNT

The MyCozyLand store has a minimum purchase of € 10 (total purchase including items and postage)
Only items with stock can be added to cart.
To place an order the User does not need to register as a customer, simply choose the items you want to order by clicking on the shopping cart icon next to the presentation of each article, or in "Add to Cart" on each tab of the article. Purchases are being added as you shop.
The User can view, edit, change or finalize their purchase by clicking the cart icon in the upper right corner of any page of the store.
You must follow all the steps of the purchase so that it is completed successfully.
Only after payment is the order considered effective and processed by the MyCozyLand team.
All promotional campaigns have a limited stock.
The "Minimum Price Guarantee" policy is not applicable to MyCozyLand.com, particularly in comparison to other online stores or other sites.
Validation of the purchase order implies that the customer has taken cognizance and expressly accepts the present General Conditions of Contract and Use, available for consultation in the online store www.mycozyland.com. The data recorded by MyCozyLand is proof of the set of transactions between the customer and MyCozyLand. It is MyCozyLand's responsibility to file the electronic documents into which the contract is made and to keep it accessible.
Once the purchase is completed you will receive an automatic email confirming the transaction. In case the data is not correct, you can immediately request its change, or the cancellation of the purchase made.

The purchase of products implies their payment and, only after receipt of payment, the order is considered effective.
MyCozyLand.com accepts the following payment methods:
. Cash Transfer
MyCozyLand authorizes Hipay to mediate payments received in the Credit Card (Visa and MasterCard), PayShop and Multibanco Referral modalities.
When choosing to pay through Paypal, the Customer or User has 60 minutes after the order to make payment of the same. If this is not verified the order is considered null.
If the customer or user chooses to pay through Hipay (Referencias Multibanco, Visa, Mastercard, PayShop), you have a period of 24 hours after the order to make payment of the same.
If this is not verified the order is considered null.
The time available for payment of the order varies depending on the service provider (Paypal / Hipay) and about which MyCozyLand does not have any interference.
. Paypal - In case the customer chooses to pay by credit card / PayPal, filling in all payment information is done directly on a secure page of the electronic payment service provider (Paypal). MyCozyLand is not responsible for any delays or non-delivery of orders caused by checks and authorizations of the issuing entities.
Both Paypal and Hipay use the 3D Secure service
The 3-D Secure protocol gives higher levels of security to consumers who shop online, since it ensures at the time of payment that the payment agent is effectively the legitimate holder of the card that is being used to purchase online. So all consumers online are more protected, preventing others from using their cards fraudulently.
. Multibanco and PayShop
This service is only available to customers residing in Portugal.
In situations of Cancellation or Returns, the Refund is made through Bank Transfer to the account of the client. You will be asked to do so, and only when a refund is involved, your NIB.
. PayShop - If you choose PayShop payment, Hipay will send an email to the customer asking for payment and as payment you can choose PayShop.
In this case Hipay will send a second email with PayShop codes so that the customer can pay the order at any PayShop point.
Regardless of how the customer chooses to pay for your order, the invoice will follow with the order.
The prices of the products are those that are disclosed in the online store, unless there is an obvious error. The online store is updated daily, however, it is possible that the information on the price of some products contains errors, so in case of this situation, MyCozyLand will inform the customer as soon as possible, giving you the possibility of Confirm the order with the correct price or cancel it, with the right to a full refund of the amount paid.
If contact with the customer is not possible, MyCozyLand reserves the right to cancel the order and to make a full refund.
The prices shown on the site already include Value Added Tax (VAT) at the legal rate (23%), according to the legislation applicable in Mainland Portugal, where the company owns the online store is headquartered.
The total amount to be paid is the value of your order with VAT and already with the delivery rate included.
Product prices may be subject to change and update. MyCozyLand reserves the right to change and / or update prices without prior notice. However, the price displayed at the time of purchase is the price actually applied, except for obvious error exceptions.
10. PRODUCT AVAILABILITY
In the sheet of each article, the customer or User finds the possible date for shipment. The times indicated refer to urgent deliveries in mainland Portugal and, from the business day following the day the order is shipped. These dates vary depending on other shipping choices and destinations other than Continental Portugal.
Since MyCozyLand does not ship orders on Saturdays, Sundays and holidays, the shipping date is always considered on the business day following the payment of the order.
Only items with stock can be added to the cart, so when the item is not available for purchase the shopping cart does not appear next to the item.
If any item ordered is unavailable, MyCozyLand will contact the customer in the following cases:
. Temporary unavailability of the article - The customer may decide whether to wait for the replacement of the article temporarily unavailable or if he wants to replace it or possibly cancel the order of the article;
. Change of price in the replacement of the item - The customer will decide whether to accept the new price, replace the item with a similar one and with the same price as the one that had initially ordered or canceled the order of the article in question;
. Absolute unavailability of stock replacement of the item - The customer will decide if he replaces the article with a similar one in his characteristics and price or if he cancels the order of said article.
In any of the situations, the order will only follow for finalization and shipment after the customer's written decision.
Whenever the customer's decision implies a refund amount to MyCozyLand will refund the amount paid by the client, within a maximum period of 14 (fourteen) days after the client's communication about his decision.
Whenever possible, MyCozyLand will try to deliver all the ordered items in a single shipment. However, if part of the ordered items is timely (2 to 5 days) or temporarily (more than 5 days) unavailable, delivery of the order may be phased. The customer or user will, in this case, be contacted by email.
The date of delivery of the article with the most extended availability should be considered.
In case the customer or user wants to receive the articles with less deadline and, do not want to wait to receive everything together, we suggest you make separate orders.
11. SHIPPING & DELIVERY
The data that is requested from the customer or users refers to the data that will appear on the invoice. If the customer or user intends to invoice with their tax number, they must fill in the "Tax Identification Number" field, as this is not a required field. If you do not do this you will receive an invoice with the generic tax number (assigned to the unidentified taxpayer). All fields with (*) are required.
The fields of optional filling (telephone, mobile phone and email) are requested to facilitate communication with the customer or user, namely receive SMS that allow you to follow the order until receiving and any clarification regarding the order).
This is the address where the customer or user wants the order to be sent. This address may or may not be the same as the address for the invoice. In any case, the shipping address is mandatory.
If you have chosen to register as a customer, all this information will be stored in your account.
The process of preparation and dispatch of the orders starts immediately after confirmation of payment of the respective order.
If the confirmation of good payment is received by MyCozyLand until 15 hours the order will be shipped on the same day, whenever possible. If this is not verified the order will be shipped on the business day following confirmation of good payment.

If the customer chooses to pick up the order in our facilities, it will not have cost.
However this option implies scheduling day and time for the order picking. In these cases we will send an email to suggest the day and time for the order pickup.

If the customer or user has a need, you can make changes to your order even after payment and, as long as it has not yet been issued. You can change billing and shipping address.

MyCozyLand.com orders are delivered through CTT Expresso, and CTT.
Once the order is processed, and at the moment the customer or user receives an email from our Customer Support to inform the shipment, the tracking number for the order will be available in the same email. Then just go to or (depending on the choice of shipment you made) and, in "following order", write the tracking number we have provided.
The customer or user can thus follow all the steps of the order that you made.
In some countries this follow up is not possible. In these cases the tracking number is no longer usable once the order leaves the Portuguese territory.
In some types of delivery, delivery is made at the address (shipping address).
The confirmation of delivery times is valid after confirmation of payment of the order.
To know the specificities of each shipping mode the customer or user can consult the shipping table above, and choose the one that best suits you.
MyCozyLand declines all liability in case of violation of the law of the country where the order is delivered. It is up to the Client to verify with the local authorities the conditions of importation or use of the products that he wishes to order.
11.1 "FREE SHIPPING" CAMPAIGN
Mycozyland offers the value of shipping costs for orders placed and paid provided that they comply with the following requirement s:
For orders with a value equal to or greater than € 75.00 and whose shipping destination is Portugal;
For orders with a value equal to or greater than € 100.00 and whose shipping destination is European Union countries.
The campaign only applies to orders weighing 1.8 Kilos or less. Orders weighing more than 1.8 kg are automatically excluded.
Excluded from this campaign are orders whose delivery is "urgent" (within 24 hours).
All rights of consumers shall remain as set forth in our terms and conditions.
12. CANCELLATIONS, EXCHANGES AND RETURNS
To cancel your order:
You can cancel your order if it has not yet been shipped. To do so, you must send us an email to express your decision to cancel the order.
At the email you will need to provide us with the order number.

In Cancellation situations, the Refund is guaranteed and made in accordance with the way you paid for your order.
- All Refunds are automatic, except payments by ATM and PayShop. In these cases the payment is made by us through a bank transfer to your account. You will only be asked for the IBAN for this purpose and only when there is a refund to be made.
If cancellation occurs after shipment, you must receive the order and, upon receipt of the order by the customer, the customer may exercise his right of Free Termination of Contract in the terms legally provided, and described below.
In this case the return costs are borne by the customer. These expenses are only the expenses with sending the articles whose order canceled.
Right of Free Termination of Contract:
In compliance with Decree Law No. 24/2014 regulating distance contracts with a view to promoting the transparency of commercial practices and safeguarding the legitimate interests of consumers, informs the following:
The consumer has the right to free resolution of his contract within 14 calendar days, without having to indicate any reason;
The deadline for exercising the right of free resolution expires 14 days from the day after the day you acquire the physical possession of the assets.
In order to exercise your right of free resolution, you must notify us of your decision to terminate the contract by means of an unambiguous statement, which must include the following information:
Identification of the recipient (if your communication is by letter);
Identification of the sender - Name and Address;
Date (if your communication is by letter);
Order number and date online;
Reference and quantity of the articles to be returned;
Signature (if your communication is by letter).

In order for the period of freedom to be respected to be respected, it is sufficient that its communication concerning the exercise of the right of free resolution be sent before the expiry of the period for termination.
Free Resolution Effects
In the event of termination of the contract, all payments made, including delivery costs (with the exception of additional costs resulting from your choice of a mode of shipment other than the least expensive modality of normal shipment offered by us) will be reimbursed ), Without undue delay and in any event not later than 14 days from the date on which we are informed of your decision to terminate the contract.
We make these refunds using the same payment method you used in the initial transaction, unless otherwise agreed by you; In any event, incur no costs as a consequence of such reimbursement.
We may withhold reimbursement until we have received returned goods, or until you provide proof of shipment of goods, whichever occurs first.
You must return the goods without undue delay and no later than 14 days from the day you inform us of the free termination of the contract. It is considered that the deadline is respected if you return the goods before the expiration of the 14 days.
You must bear the direct costs of returning the goods.
It is only responsible for the depreciation of goods resulting from manipulation that exceeds what is necessary to verify the nature, characteristics and functioning of the goods (Similar to what you would do if you were to buy from a store).
Thus, in relation to the goods to be returned, the following must be taken into account:
The product has not been used or tampered with;
The product retains its original characteristics and the packaging is not totally damaged.
13. WARRANTIES AND AFTER-SALES ASSISTANCE
AFTER SALES SERVICE
In compliance with the provisions of Decree-Law 67/2003 of 8 April amended by Decree-Law no. 84/2008 of May 21, MyCozyLand informs:
Consumer Assurance and After Sales Assistance
All mobile consumer goods are covered by a 2 year compliance guarantee.
In case the purchased product is defective or damaged, you must inform us by contacting our customer support

You must give us the order or invoice number as well as a brief description of the defect or problem.
A. Damage During Transportation
If you receive damaged packaging and/or damaged items.
At the time of delivery should check the content and submit the complaint to the carrier in writing and at the time of delivery.
Soon after (within 24 hours) you should contact us at or at +351 930 605 990.
In case of receiving an order with the packaging in good condition but whose contents are damaged must (within 24 hours) contact us through the above means.
We will initiate an investigation, so that the situation is resolved as soon as possible.
In case of damages in the transport, as in cases of loss of the order or impossibility of delivery to the recipient, we will initiate an investigation, reason why we can take up to 14 working days to confirm the occurrence. During this time we will not be able to make any refunds.
B. Dissatisfaction with Article
If you are not satisfied, you can return your purchases.
In this case, you have a period of 14 days to do so, as provided in the Law and, above referred to in "Right of Free Termination of Contract"
Please note, however, that you should not send articles without prior contact with us as they will not be accepted.
C. Technical Nonconformity of Article
If one or more articles of your order are incompatible with the advertised, you must contact our customer support, so that we can request the collection of the articles in question.
For this, you have a period of 2 months to inform us of the nonconformity of the article.
If the invoice date of the article concerned is less than 30 days
When contacting our customer support, have your order number and/or invoice in hand.
The costs of collecting items within the warranty period will be borne by MyCozyLand.
Once we receive the article, we will verify it and, if any nonconformity is verified, the article will be replaced. In this case, we will send a new one to your address at no cost to you.
If it is found that the article has marks of misuse and / or incorrect use (example: not respecting the indications of the manufacturer) we will contact you to indicate to us if you want that we return the article in the state in which it is or, And if possible, you want us to ship the item to the manufacturer for repair. In this case, the repair of the article, as well as the costs of collection and reshipment are the responsibility of the client.
Items will only be sent for repair after written approval of the client's budget and payment of 50% of the value of the arrangement.
When the damages are not covered by the warranty, the transportation costs involved in resolving the problem are the responsibility of the customer.
If the invoice date of the article in question is more than 30 days
The item will be sent for repair to the manufacturer under the warranty (valid for 2 years after the date of purchase).
The costs of collecting items within the warranty period will be borne by MyCozyLand.
If the damage is not covered by the Guarantee, the manufacturer will issue a technical opinion and, if it is possible to repair, send a budget. The client will be contacted by MyCozyLand who will provide the budget and will request confirmation of the same, as well as the payment of 50% of the value of the budget.
Repairs will never be initiated without written confirmation and payment of 50% of the budget amount.
When the damages are not covered by the warranty, the transportation costs involved in resolving the problem are the responsibility of the customer.
D. Warranty Repairs
All products purchased from MyCozyLand benefit from a two (2) year legal warranty of compliance from the date of delivery to the customer.
The estimated period of repair is 30 (thirty) days.
If the technical verification detects signs of misuse, and / or any problem that may have caused the fault (eg: failure to comply with manufacturer's instructions), the customer will be contacted to indicate if he or she intends to repair the equipment, The corresponding repair budget.
The repair process will only begin after payment of 50% of the amount budgeted.
14. GOVERNING LAW
All purchases made on are subject to Portuguese law. Any conflict or divergence of interpretation of the General Conditions of Contract and Use shall be submitted to the competent Portuguese Court.
In the event that the client is outside Continental Portugal, we hereby inform that any judicial proceeding must be sent to the Portuguese courts.
In the case of a Consumer Dispute, the user may use the following Alternative Dispute Resolution entities.
